Lithium-Ion Battery Safety Legislation: Progress Stalls, But Advocacy Continues

Despite significant progress, the Setting Consumer Standards for Lithium-Ion Batteries Act (S.1008 and H.R.1797) ultimately did not pass. 

While this outcome is disappointing, it highlights growing bipartisan support for national safety standards to address the fire risks of lithium-ion batteries in e-bikes and scooters. 

This marks the furthest advancement of a BOMA-supported bill, setting the stage for continued advocacy efforts in the next Congressional session. 

What You Need to Know

Although the legislation didn’t pass, it showed strong support for tackling the risks of unregulated lithium-ion batteries.  

The bill would have: 

  • Required the Consumer Product Safety Commission (CPSC) to establish safety standards within 180 days. 
  • Standardized safety regulations for manufacturers, users, and sellers of e-mobility devices. 
  • Reduced the risk of fires, fatalities, and property damage linked to defective or damaged batteries. 

BOMA International played a key role in advancing this legislation and will continue to advocate for its passage in future sessions. 

How It Impacts You

Although the bill didn’t pass, lithium-ion battery risks remain a serious concern for commercial properties. Property managers should take steps to reduce these risks: 

Update Fire Safety Plans: Update emergency procedures to address lithium-ion battery fire risks. 

Ensure Proper Storage and Charging Areas: Find safe storage areas and ensure charging stations meet fire safety standards. 

Review Lease Agreements: Add guidelines for the safe use and storage of micromobility devices to policies.
